«CORPORATIO» AS AN INSTITUTIONAL FORM: THE ONTOLOGY OF THE COLLECTIVE

The article analyzes the origins of the concept of corporation, derives definitions of its lexical and semantic field, and outlines a cross-section of its manifestation as an institutional form. In particular, the emphasis is shifted to the mechanisms of fixing the ontology of the collective, which at one or another period of historical development expressed the reality of joint existence through the legal form. Whether it is «être-avec» / «being-with-others» or «legal body» («persona iūridica», «corpus naviculariōrum»), any of these fixed mechanisms leads to an explanation of the existence of a form of being where the general exists not as a mechanical sum, but as a separate independent reality. To illustrate and express the theoretical material, we turn to the phenomenon of the university, the university system, which acts as an institutional form of corporatio and, in the mode of its own functioning, demonstrates all the specifics of the ontological manifestation of a corporate association. Thus, the university as an institutional form of corporatio reveals the ontology of the collective through community in a single legal personality. This community has its own statute, property, and the right to speak on behalf of knowledge, assigning titles or viewing truth as a public good. The university exists as an order of recognition and procedures that maintain the continuity of its «legal body» through archives, structural divisions, leadership, change of student generations, etc.
